Basketball Programs Liability Waiver

I, hereby acknowledge that I am voluntarily participating in physical recreational activities organized and facilitated by Unique Hoops Basketball Academy. In consideration of being permitted to participate in these activities, I agree to the terms outlined in this waiver of liability.


  1. Assumption of Risk: I understand that participating in physical recreational activities carries certain inherent risks, including but not limited to, physical injury, property damage, or even death. I voluntarily assume all such risks and acknowledge that Unique Hoops Basketball Academy cannot guarantee my safety during these activities.
  2. Release and Waiver: I hereby release, waive, discharge, and hold harmless Unique Hoops Basketball Academy, its owners, directors, employees, agents, contractors, and volunteers from any and all liability, claims, demands, actions, or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by me or to any property belonging to me, arising from my participation in these activities, regardless of whether such loss, damage, or injury is caused by the negligence or fault of Unique Hoops Basketball Academy or any third party.
  3. Indemnification: I agree to indemnify and hold harmless Unique Hoops Basketball Academy from any claims, actions, damages, liabilities, costs, or expenses, including legal fees, arising from or in connection with my participation in the physical recreational activities provided by Unique Hoops Basketball Academy.
  4. Medical Treatment: In the event of any injury or illness during my participation in these activities, I authorize Unique Hoops Basketball Academy and its staff to administer or seek medical treatment on my behalf, including but not limited to, arranging for emergency medical services, transportation, or hospitalization, if deemed necessary. I understand that I am solely responsible for any medical expenses incurred as a result of such treatment.
  5. Severability: If any provision of this waiver of liability is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.
  6. Safety and Equipment: Parents should ensure that their child comes prepared for each session with the appropriate sports attire and equipment, such as proper footwear . They should also emphasize the importance of following safety guidelines and instructions provided by the academy to minimize the risk of injuries.
  7. Property Damage: I  agree that as a parent or legal guardian of the participant, I am solely responsible for any damage done, lost, or stolen property belonging to Unique Hoops Basketball Academy or any other individual caused by their actions during the activities. I understand and accept that Unique Hoops Basketball Academy and its representatives will not be held liable for any such damage, loss, or theft. In the event that any costs are incurred as a result of such damage, loss, or theft, including but not limited to repair or replacement expenses, I agree to assume full financial responsibility. I understand that Unique Hoops Basketball Academy will hold me, as the parent or legal guardian, liable for any and all costs associated with such incidents."

I affirm that I am of the age of 18 years or older, and I have carefully read and understood the contents of this waiver of liability, and I voluntarily agree to its terms. I acknowledge that by signing this waiver, I am releasing certain legal rights that I or my heirs, executors, administrators, and assigns may have against Unique Hoops Basketball Academy, and that this release cannot be modified orally.

I need the parents to sign an acknowledgement and agreement for our policies also. 


EQUIPMENT: All participants must bring their OWN basketballs to workouts. Players can rent out a basketball for the day for an additional fee of $5 per session.

 

PARENT SIT IN: Parents are allowed to sit in during basketball sessions. However, this policy might be subject to change during the month. Please ensure chairs are put back into place at the end of each basketball program.

 

ARRIVAL / CHECK-IN / CHECK-OUT: Parents MUST bring participants into the facility. All participants will enter and exit through the main door.

 

MAKEUP DAYS: Please review your schedule and any other conflicts you may have. We do not offer makeup days due to participants missing ANY of our workouts.

 

REFUNDS: After registration, a credit will be used for future programs if there is an injury at the start of your selected program. All credits are good for one year from the date of the canceled session.

 

COMMUNICATION: It's essential to check your email and turn on your Brightwheel updates regarding all of our basketball programs.

 

ATTIRE: Please make sure all participants are dressed appropriately to play basketball. T-shirt, shorts, and basketball sneakers.

 

PARENTS' CODE OF CONDUCT: We do not tolerate hostile, rude, disruptive, or inappropriate behavior by parents/guardians. Failure to obey our code of conduct will result in the termination of participants in the selected basketball program. NO REFUNDS will be given to any parents who violate our Parents Code of Conduct.

 

VIDEO/CAMERA: We understand that you may want to capture your child on the video to see and maybe look back on what they did during our training, but we ask that you DO NOT record any videos of our workouts. We use our own media, and we need to ensure we're protecting all our participants' images.


DO NOT COME: If you're at a higher risk of serious illness, you WILL have to wait until symptoms clear before you are allowed to return to workouts.
